About this agreement

  1. These Terms of Service shall apply to the use of SPACE ATHLETIC TONDEMI (hereinafter referred to as "the Facility") operated by Bandai Namco Amusement Inc. (hereinafter referred to as the "Company") and the individual services (including advance reservations and membership registration site links; hereinafter referred to as "the Service") provided on this website (hereinafter referred to as the "Site").
  2. The agreements on this site, the display of terms and conditions of business, and the notes on the use of the Facility (including notices posted in the Facility, hereinafter referred to as "Individual Regulations") shall supplement or constitute a part of these Terms of Service. In the event of a conflict between the Individual Regulations and the content of these Terms of Service, the Individual Regulations shall take precedence.
  3. The Company may change the contents of these Terms of Service and Individual Regulations as needed. If the Company makes any changes to these Terms of Service and Individual Regulations, the Company shall announce said changes in advance through the Site, and the revised Terms of Service and Individual Regulations (limited to critical regulations in the case of notices posted in the Facility) will become effective when posted to the Site.
    Even if a portion of these Terms of Service and Individual Regulations is deemed invalid under any law or regulation, it shall not affect the validity of other provisions.
  4. Customers who use this Service are deemed to have agreed to all of these Terms.

Objects to which this agreement applies

These Terms of Service apply to all customers who use this Service, regardless of whether they are members or non-members of the Facility.

About use by minors

  1. If you are a minor, please be sure to check these Terms of Service with your legal representative (person with parental authority, etc.) and use this Service only if your legal representative agrees to these Terms of Service.
  2. If the Company individually requests the consent of a legal representative to provide this Service, minors must obtain the consent of their legal representative.

About membership registration

  1. Membership registration is required to use the Facility (excluding the Kids Area).
    Registration fee, membership fee: 600 yen (500 yen at the Ehime location)
    Validity period: doesn’t expire
  2. Members can cancel their membership at any time by applying in accordance with the procedures prescribed by the Company.

Registration information when using

  1. If it is necessary to register information before using this Service, the user shall register accurate information. In addition, if there is any change in the registered information, the user shall promptly update said information.
  2. The Company will use personal information to the extent necessary to achieve the purposes of use set forth below.
    1. To manage reservations at the Facility
    2. To contact the user in the event of an emergency
    3. To respond to inquiries
    4. To provide facility information
    5. To gather opinions and conduct marketing research on the research, development and provision of new facilities and services
    6. To help customers feel more comfortable using the Facility

Please refer to the Company’s Privacy Policy regarding the disclosure of personal information (disclosure, notification of purpose of use, correction, deletion, suspension of use) and other matters relating to personal information.
The member registration system uses services provided by KEY Planning.co.,ltd and Inter Quest Co.,Ltd. However, KEY Planning.co.,ltd and Inter Quest Co.,Ltd. do not use or retain personal information.

About the use of this facility

The following content applies all TONDEMI facilities. Please read through it.

<Usage restrictions>
Those who meet the following requirements can use the Facility.

  • Height: 110cm or taller (Makuhari location: 110cm - 190cm) / Weight: 20kg - 120kg
  • Kids Area: Children 3 years old and above, with a height of 120cm or less (Heiwajima location: 2 years old and above, with a height of 120cm or less)

* Elementary school students and younger must be accompanied by a guardian.

<Precautions for use>

  • No alcohol or smoking is allowed on the premises.
  • You cannot enter the venue after drinking or while under the influence of alcohol.
  • Pregnant users are only allowed inside as guardians. Pregnant users cannot participate in activities.
  • Users who are undergoing treatment for any of the following ailments or who have received special instructions from a doctor, such as restricting exercise, are not permitted to use the Facility.
    1. Diseases of the neck, back and spine (vertebral column), legs
    2. Heart disease
    3. Arthritis, hypertension, cardiovascular disease (disorder)
    4. Other physical ailments
    5. Those who cannot support themselves
  • Please store your belongings in a locker or keep it on your person.
  • Please keep track of all your valuables. We are not responsible for any loss or theft.
  • The Company shall not be held responsible for any damage or malfunction to personal belongings (clothing, shoes, glasses, precious metals) or property (cameras, video cameras, mobile phones, smartphones, etc.) within the Facility.
  • For safety and hygiene reasons, please be sure to wear TONDEMI original socks in each area.
  • If you feel unwell at any time, please stop using the equipment immediately.
  • Please refrain from the following actions as they may cause injury.
    (Example)
    • Wearing accessories (watches, necklaces, bracelets, earrings, hairpins, etc.)
    • Operating smartphones, cameras, etc. while playing
    • Chewing gum or eating while using the equipment
  • The Company has prescribed usage precautions for each area. Please be sure to comply with these precautions when using the Facility.
  • In addition, if you do not follow the instructions of the staff or violate any usage rules, you may denied use of the facility. Please note that even in such cases, usage fees, registration fees, etc. will not be refunded.

About prohibited items

  1. When using the Service, the following conduct is prohibited. Whether or not said conduct constitutes a violation is at the discretion of the Company.
    1. Violations of laws and regulations (acts against public order and morals, infringement of intellectual property rights, defamation, unauthorized computer access, creating and providing computer viruses, etc.)
    2. Acts of transferring, assigning, lending, pledging or otherwise disposing of the rights and obligations arising under these Terms of Service to a third party
    3. Acts that interfere with the smooth provision of the Service (obstruction of other visitors' use of the Service, unreasonable inquiries that exceed the legal responsibility of the Company or third parties, etc.)
    4. Acts of reporting false facts when using the Service
    5. Acts that violate these Terms of Service and Individual Regulations
    6. Other acts deemed by the Company as inappropriate
  2. If the Company finds that a user committed a prohibited act, the Company may take the following measures. In such cases, the Company shall not be obligated to refund fees and shall not be obligated to disclose the reason thereof.
    1. Deprivation of membership
    2. Temporary or complete suspension of use of the Service
  3. If it is reasonably determined that a visitor falls under Paragraph 1 or any of the following items, the said visitor may be refused usage of the Service at the Company’s discretion. In such cases, except in the case of (3), the Company shall not be obligated to refund the fee and shall not be obligated to disclose the reason thereof.
    1. In the event that the respective credit card company did not approve a given transaction
    2. User who have previously violated these Terms of Service or Individual Regulations
    3. The user, being a person with limited capacity such as a minor, has not obtained the consent of a legal representative such as a guardian.
    4. Gangs, organized crime group members, associate members of organized crime groups, corporate racketeers, social movement thugs, special intelligence organized crime groups, or other users similar to these (hereinafter referred to as "anti-social forces"), or users deemed to have had interaction with or involvement with anti-social forces
    5. Any other cases in which the Company deems the use of the Service by the customer to be inappropriate.

disclaimer

  1. The Company may suspend or discontinue part or all of the Service without prior notice.
  2. The Company makes no guarantee, explicit or implied, regarding the completeness, accuracy, merchantability, suitability for a particular purpose, non-infringement, or anything else with respect to the Service.
  3. The Company shall not be involved in any dispute arising between users and third parties (including payment service providers for the Service and advertisers displaying advertisements within the Service).
  4. The Company may, without prior notice to the users, temporarily suspend the operation of the Site in the event of periodic or urgent maintenance, or in the event that the Company deems it necessary to suspend all or part of the Site temporarily due to operational or technical reasons. In such cases, the Company shall not be held liable to the users.
  5. The Company shall not be held liable for any damages to the users resulting from acts of God, epidemics, social upheavals, strikes, fire, power outages, outages of telecommunications infrastructure, or other causes beyond the Company's control.
  6. The Company shall not be held liable for any damages to users’ communications devices, deletion of reservation completion emails or other data, loss, theft, device changes, or malfunctions that prevent users from using the Service.
  7. The Company may, without prior notice to users, discontinue provision of all or part of the Service in the event that the Service may infringe upon the rights of a third party, if there is a possibility of a lawsuit for defamation, etc., or in any other case in which the Company deems it necessary to discontinue providing the Service. In such cases, no Facility usage fees will be charged.

Compensation for damages

  1. Notwithstanding any other provision of these Terms of Service, in the event that users suffer damages in connection with the Service for reasons attributable to the Company, the Company shall be liable for compensation for such damages up to the amount already paid directly or indirectly to the Company, limited to the extent of damages that would typically be directly caused to the users with respect to said Service. However, this shall not apply in the case that the user suffers damages due to the Company's willful misconduct or gross negligence.
  2. If the user causes damages to the Company due to the violation of these Terms of Service or other reasons attributable to the user, the user shall be held liable for compensating said damages to the Company.

Attribution of Intellectual Property Rights

The intellectual property rights and all other rights pertaining to the Service (including any and all inventions, ideas, designs, trademarks, marks, images, videos, text, programs, and all other information, etc., contained therein) belong to the Company or third parties that have granted the Company with the right to use of.

Governing Law and Agreed Jurisdiction

  1. These Terms of Service shall be governed by and interpreted in accordance with the laws of Japan.
  2. If a lawsuit arises between a user and the Company with respect to these Terms of Service, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
